These Terms & Conditions ("Terms") govern your use of the AlarmiFex iPhone app, the website at alarmifex.amdose.com, and the AlarmiFex sound catalog (together, the "Service"), operated by AlarmiFex ("we", "us", or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using AlarmiFex, you confirm that you meet this requirement and that any information you provide is accurate.

2. The Service

AlarmiFex is an iPhone alarm app that lets you wake to any song or your own recorded voice. It schedules alarms through Apple's native AlarmKit and plays sounds downloaded to your device, so alarms can ring on silent, on Focus / Do Not Disturb, on the lock screen, and offline. While we work hard to keep alarms reliable, the Service depends on your device, its settings, available storage, battery, and operating system. You are responsible for confirming that your alarms are set correctly and that your device is able to play them. We are not liable for any missed alarm, oversleeping, or resulting loss.

3. Your Account

Some features require an account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Your Content

"Your Content" means the songs, audio, voice recordings, titles, descriptions, and artwork you upload, import, create, or publish. You retain ownership of Your Content. By using the Service, you grant us a limited, worldwide, non-exclusive license to host, store, process, and play Your Content solely to operate and provide the Service to you.

You represent and warrant that you own Your Content or have all rights necessary to use it, and that it does not infringe anyone's intellectual property, privacy, or other rights. You are solely responsible for ensuring you have the right to use any music or audio you add — including content protected by copyright. Do not upload material you are not authorized to use.

5. Publishing to the Catalog

If you publish a sound to the AlarmiFex catalog, you grant us and other users a non-exclusive license to access, download, and use that sound within the Service. You must hold all rights necessary to share it publicly. We may review, decline, remove, or remove from distribution any submitted sound at our discretion, including content that infringes rights or violates these Terms.

6. Acceptable Use

You agree not to:

  • Upload or publish content you do not have the right to use, or that is unlawful, infringing, harmful, hateful, or obscene;
  • Reverse engineer, decompile, or attempt to extract source code from the app, except where permitted by law;
  • Interfere with, disrupt, or place undue load on the Service or its servers;
  • Access the Service through unauthorized automated means or attempt to bypass security or usage limits;
  • Use the Service to violate any applicable law or the rights of others.

7. Premium Features and Subscriptions

AlarmiFex may offer paid features or subscriptions ("Premium"). Purchases are made through the Apple App Store and are subject to Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID settings. Except where required by law or Apple's policies, payments are non-refundable. Prices and Premium features may change; we will provide notice where required.

8. Intellectual Property

The Service, including the AlarmiFex name, logo, software, and design, is owned by us and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the app on devices you own or control, for personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.

9. Third-Party Services

The Service relies on third parties, including Apple (App Store, Sign in with Apple, AlarmKit) and our hosting and infrastructure providers. Your use of those services may be subject to their own terms, and we are not responsible for them.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY ALARM WILL SOUND IN EVERY CIRCUMSTANCE. AlarmiFex IS NOT A LIFE-SAFETY DEVICE AND SHOULD NOT BE RELIED ON AS YOUR ONLY ALARM WHERE MISSING IT COULD CAUSE HARM.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AlarmiFex AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM A MISSED OR FAILED ALARM, LOSS OF DATA, OR LOSS OF PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless AlarmiFex and its operators from any claims, damages, and expenses arising out of Your Content, your use of the Service, or your violation of these Terms or the rights of others.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect means you accept the revised Terms.

15. Governing Law

These Terms are governed by applicable law without regard to conflict-of-law principles. Any disputes will be resolved in the competent courts of the applicable jurisdiction, except where local consumer law gives you the right to bring proceedings elsewhere.
